- “Contract” refers to these Terms of Business between the Company and You.
- “Claim” refers to the formal complaint we file against Your financial institution on Your behalf.
- “Bank” refers to any financial institution, including banks, credit card companies, building societies, or other such entities.
2. Our Services
We agree to:
- Evaluate your case and pursue a Claim on your behalf if appropriate.
- Handle all aspects of Your claim, including communication and negotiation with financial institutions.
- Keep You updated on claim progress, including offers and settlements.
- Provide advice on accepting or rejecting settlement offers.
- Take actions in Your best interest while pursuing Your claim.
3. Your Obligations
You agree to:
- Provide accurate information and supporting documents promptly when requested.
- Inform Us of any communication from Your financial institution, including Compensation payments.
- Authorize Us to file Your Claim with relevant authorities if deemed necessary.
- Keep Us informed of any offers of Compensation You receive.
- Grant Us sole authority to act on Your behalf in pursuing claims and negotiations.
- Inform Us immediately of any changes in Your contact details.
4. Cancellation and Termination
We reserve the right to cancel this agreement at any time. We may immediately terminate the Contract by written notice if You declare bankruptcy, enter into a voluntary agreement with creditors, or are subject to the Mental Health Act 1983.
5. Our Performance
We are responsible for Our actions and performance as described in this agreement. We cannot guarantee the success of Your Claim or be held accountable for the performance of third parties (e.g., Banks, FOS, FCA, FSCS).
6. Use of Your Information
We may share your information with financial partners, banks, Service, and other third-party suppliers while administering Your case. For details on how we collect, store, use, and share Your personal data, please refer to Our Privacy Policy at [insert website URL].
7. Our Liability
Nothing in this Contract shall exclude or restrict our liability for:
- Death or personal injury caused by our breach of duty
- Breach of obligations implied by the Supply of Goods and Services Act 1982 or the Sale of Goods Act 1979
- Any other liability that cannot be limited or eliminated by applicable law
We are not liable for any consequential loss or other results if a Bank deems it necessary to close a Client’s account.
8. Law and Disputes
This Contract is governed by the laws of England and Wales, under the exclusive jurisdiction of English Courts. If any part of these Terms is held invalid or unenforceable, the remaining Terms will remain intact.
